Terms & Conditions of Sale

The following terms and conditions apply to all Maxwell's transactions that are processed. This is applicable to all on-line, telephone, fax, e-mail, showroom or commercial transactions. Please read the terms and conditions carefully and print a copy for reference.

We reserve the right to change our terms from time to time so please check them before making a new purchase.

Payment
All prices shown are in £ sterling and include VAT and we reserve the right to change any advertised price at any time. You can pay for your order by Cheque (funds will need to clear before delivery if order exceeds guarantee card limit) MasterCard, Visa, Delta, Maestro, Solo or Switch by telephone through our sales team or by person in our showroom.

Title
Title of goods shall remain with Maxwell's until paid in full.

Order Confirmation
Orders placed with Maxwell's will only be considered valid when our sales representatives have confirmed the product details of your order either in writing or verbally, and given an anticipated delivery date. A binding agreement arises once we accept your order and we will then take payment for the product/s on acceptance of your order. We will then provide a confirmation of order to you.

If an order is received for a discontinued model we will automatically provide the up to date equivalent model providing it is readily available and is the same price as the discontinued model. If there is no updated model available we will discuss further options.

Guarantees
All products advertised on the Maxwell's website are accompanied by a full manufacturers warranty for a minimum of 1 year up to a maximum of 10 years for selected products. All products that are in warranty are serviced and repaired by the manufacturers if a fault occurs during the warranty period. Liability for failure of any product sold by Maxwell's is restricted to the replacement or repair of that appliance and any claim for consequential loss through failure of that product is not the responsibility of Maxwell's. If deemed that a new appliance is considered faulty and beyond normal repair Maxwell's will exchange the appliance as soon as possible but in all cases an appliance will not be deemed to be faulty until the manufacturer or their service agent has inspected the appliance. Should the appliance prove to be in full working order or should the fault prove to be due to poor or incorrect installation then the manufacturer or agent may wish to levy a callout charge to the customer for their time. Please take time to read and observe the instruction manuals and literature provided with the appliance/s and carefully follow the necessary instructions for installation and use.

Delivery/Installation and Repair Information
All delivery times quoted are an estimate and are subject to change. Maxwell's can only take responsibility for delivery of appliances once they have been received into our warehouse and without prejudice to the statutory rights of customers under English Law. Maxwell's accept no responsibility for consequential losses due to late delivery or failure of third party manufacturers or transport agents to dispatch ordered goods. We strongly advise that customers do not book fitters until they have received their product/s and checked them for damage. Delivery is based on a doorstep delivery to a ground floor location. Maxwell's reserve the right to charge an additional delivery charge to a location above or below the ground floor. It is the responsibility of the customer to ensure that the product/s ordered will pass through any doorways in their packaging, and all installation conditions are correct. Maxwell's reserve the right to make a failed delivery charge should the customer be absent or access is too difficult.

Inspection of Product/s
Where product/s are delivered directly to your premises it is your responsibility to ensure that there is a responsible person on site to inspect and to sign for the goods. When the product/s arrive, please make sure that they are unpacked and inspected before signing the delivery note. In the unlikely event of damage occurring during transit, please refuse delivery of the product/s and notify us immediately. We cannot accept liability for damages or errors if product/s have been fitted or if you have had the appliance/s in your possession for more than 7days. Please ensure that you keep the original packaging in case you have any reason to return your purchase. Your statutory rights are not affected by this clause.

Cancellation and Returns
You have the right to cancel your order within 7 days of receipt of your product/s, without giving a reason. The customer has the right to either return the product/s themselves or request us to collect the product/s. If the customer requests us to collect the product/s the cost of collection will be deducted from the refund. All products must be returned in their original packing and intact. The 7 day cancellation period for each appliance begins the day after the day of delivery of that appliance. Each cancelled product will be subject to a restocking charge and the percentage will be dependent on the product returned.

General Limitations and Liability
Without prejudice to statutory rights given to purchasers of products, the information and materials contained in this website, including without limitation, graphics, text and links, are provided to the best of our knowledge and ability. Maxwell's cannot accept liability as to the completeness of accuracy of the contents, products or services portrayed within. Maxwell's only sell products that are suitable for use in the UK and we do not provide any testing of products for safety, quality, compliance, reliability or function. No assurance is given that this website is free from errors or viruses and use of this website is at your own risk.
